1 REFUSE/ WASTE COLLECTION / LITTERING
1.1 No owner or tenant shall himself throw or permit to be thrown, or allow persons under his control or for whom he might reasonably be responsible to throw or permit to be thrown, rubbish/refuse and/or other waste from his dwelling onto his Erf or generally litter upon his property or the common property.
1.2 All general household waste must be placed in sealed plastic bags on the verge of your Erf outside your own dwelling and not anywhere else, for collection by the resort staff by not later than 8h15 on Monday mornings (or such other times communicated from time to time). It is preferable to place your refuse in a raised refuse bag holder.
1.3 Refuse bags (Plastic and/or other bags) are obtainable on signature from the preferred collection point within the development. These are provided in a three-monthly cycle, with 20 bags being provided every three months. For more information, please contact the GAMHOA Office.
2.1 In order to gain access / egress to the GAMHOA premises each homeowner/occupier will need a remote control for the motorised vehicle gates. Remotes for tenants must be supplied by the owners and tenants are unable to buy remotes. The number of remotes to be made available to residents is limited to two remotes per householder (for security purposes).
2.2 Only registered Homeowners may purchase a remote unless sanctioned by the Board of Directors. Under no circumstances will homeowners be allowed to purchase remotes for friends or strangers to enter and exit the Resort.
2.3 Cell phone access control is also available for homeowners and or tenants with permission from the owner at an annual fee.
2.4 Appointed building contractors may be provided with a remote by the homeowner concerned, who should arrange the same.
2.5 Access remote controls and cell phone access are available from the GAMHOA Office during official office hours. Mondays to Fridays 08h00 to 12h00. Telephone 042-286 0819.
3.1 All Municipal bylaws regarding the keeping of dogs, animal, reptiles and birds in the Kouga Municipal District must be strictly adhered to.
3.2 Homeowners/tenants must keep control of their dogs at all times. Dogs must not be a nuisance to others in the Resort. Leashes must be used when walking dogs. Homeowners must please pick up their own dog’s litter when walking dogs on POS or on other Homeowners erven. Letting your dog’s roam the resort freely is prohibited.
3.3 Each house holder is allowed to have two dogs only.
3.4 Each house holder is allowed to have two cats only. Both must be neutered/spayed.
3.5 Bell collars for cats are compulsory.
3.6 Any exception to these rules must be applied for in writing and addressed to the Managing Agent.
4.1 The homeowner / occupier shall not place or do anything on any part of the common property or on his dwelling or erf, which at the discretion of the Directors, is aesthetically displeasing or undesirable when viewed from the outside of the premises.
4.2 Notices on your Erf. No sign or advertisement or notice shall be painted, fixed or hung on any part of a residential dwelling or a building or on the homeowner’s property, without the prior written consent of the Board having first been obtained. The following are excluded:
- The house’s name.
- The house’s number
- Armed Security notice boards.
- Property for Sale notice boards. (All must be made to professional standards).
- Note: Builders advertising boards must be applied for.
4.3 Notices on POS. Notice boards displayed by Property Sales Agents, Building and sub- contractors and others, must be placed at the prescribed location identified by the GAMHOA Management. For Sale/On Show signs displayed outside the entrance gates on POS are allowed from Friday 17:00 until 08:00 on Monday mornings only. Thereafter they must be removed.
5 CONTROL, GENERAL, JOYRIDING AND SPEEDING
5.1 No unlicensed vehicles are allowed to be driven on resort roads by children or adults. Also, no joy riding is permitted in the Resort.
5.2 A children’s playground has been provided in Phase 1 near the Kabeljous gate. Please use it at your own risk. The onus is on the parents to keep the children under control.
5.3 The speed limit within the Resort is 20 km/h.
6 QUERIES, SUGGESTIONS, ANNOYANCES/COMPLAINTS AND CONCERNS
6.1 Any annoyances or complaints must be lodged in writing and addressed appropriately.
6.2 These may either be emailed to hmarais@bellbuoy.co.za (Managing Agent 041-374 4444) or emailed to gamtooshoa@truewan.co.za or mailed to P O Box 213, Thornhill, 6375, or hand delivered to the GAMHOA Offices.
6.3 Annoyances or complaints must be factual and specific and if possible must specify the time and date of occurrences, as well as the names of the persons involved and, if applicable, the numbers of the dwellings where the incident(s) took place and whose occupants are allegedly responsible for the incident(s). These details are required in order to enable the Exco/Directors to act and avoid recurrences.
7.1 As we are an eco-resort and some of our erven are smallish and quite close together (high density), especially in the Kabeljous suburb, consideration of neighbours is obligatory and the level of noise is restricted.
7.2 As a guideline, reasonable quietening/toning down is expected from 10pm, and silence from 12 midnight daily.
7.3 However, Kouga Municipal by laws and National Legislation apply, and override the aforementioned comments. For those who wish to party late into the night, we recommend a venue outside the resort.
7.4 Noise from power tools after 1pm on Saturday through to Monday 7am and/or on public holidays and/or during the annual building industry shutdown, is only allowed when doing your own household and asset repairs and maintenance. However, good neighbourliness is encouraged.
Should the Duty Manager find the noise excessive, after investigating a complaint, he will request the homeowner to cease the use of the offending power tool or equipment.
7.5 In the event of an emergency, the use of power tools will be allowed for the duration of the emergency.
7.6 All residents’ behaviour should be of such a nature so as not to cause any disturbance to your neighbours or to the normal peaceful environment of the Resort.
7.7 Also be considerate with regard to the length of time and the time of day when using power tools.
8 MALICIOUS DAMAGE, DEFACING, GRAFFITI, ALTERATIONS OR ADDITIONS TO THE COMMON PROPERTY. THIS INCLUDES BUILDINGS, THE SUB-STATION, MINI-SUBS, KIOSKS, ETC AND PUBLIC OPEN SPACE.
Homeowner’s or tenants shall not mark, paint, drive nails, or screws or the like into, or otherwise damage or alter or break into or interfere with any part of the common property without first obtaining the written consent of Management and the Board.
9 DOMESTIC WORKERS, AND ANY OTHER WORKERS
9.1 Domestic’s or other workers shall not be permitted to reside or overnight in a dwelling or in or on common property of the development, unless they are given proper and adequate accommodation on the premises. Management must be notified. Refer to the Site Instructions regarding the labourers of contractors.
9.2 For security monitoring purposes, all workers entering and exiting the resort are to have and wear ID discs, obtainable by the employer, from the GAMHOA Office.
9.3 For security monitoring purposes no loitering or wandering around or site-seeing by any workers on the POS or on unauthorised private property is allowed.
10.1 All tenants of units and other persons granted right of occupancy by any homeowner of the relevant unit are obliged to comply with the GAMHOA rules.
10.2 Homeowners are to address and remedy any bad behaviour by their tenants. Homeowners are directly responsible.
10.3 Owners / agents of guest homes must advise GAMHOA office of the arrival and departure dates of their visitors.
10.4 Homeowners and or letting agents must advise GAMHOA office of permanent or temporary tenants and their contact details. The owner and the tenant must fill in and sign Annexure A attached hereto and submit the form to the GAMHOA office.
10.5 Homeowners and or letting agents must provide the tenants with copies of the Resort Rules and Slipway Rules either by email or by leaving copies in the house and must explain the rules their tenants.
10.6 Short term tenants will only be given access by remotes, but not cell phone access, to the Resort.
11.1 Each homeowner / occupier must provide off-street parking for his/her vehicles.
11.2 Homeowners / occupiers of vehicles illegally parked on the verges and blocking the roadways will be asked to remove their vehicles. Fines will be issued to persistent offenders.
11.3 Homeowners / occupiers may not park their vehicles on other homeowner’s vacant plots without their specific permission. They can park on public open space areas where it is safe to do so and as long as they don’t harm the vegetation in the immediate vicinity.
11.4 The Directors may cause to be removed or towed away at the risk and expense of the homeowner/owner of the vehicle/boat, any vehicle/boat parked illegally or standing on or abandoned on the Gamtoos Mouth Homeowners Associations property. This without the homeowner’s/owner’s consent.
11.5 No homeowner or occupier shall be permitted to park or dismantle or affect major repairs to any vehicle/boat on any portion of the GAMHOA premises. This does not apply to the homeowner’s own erf. This, so long as the erf does not start resembling a motor vehicle/boat repair/maintenance business or scrap site.
12 USE OF PRIVATE OPEN SPACE – SLIPWAY
12.1 The slipway facility is strictly for use of homeowners / occupiers only.
12.2 No homeowner/tenant shall buy and then lend remotes out to friends.
12.3 The full slipway protocol is available from GAMHOA Offices and on the website www.gamtooshomeowners.co.za.
12.4 All slipway users must contact the GAMHOA Office to enable them to register and adhere to the boat and slipway rules and regulations.
12.5 All slipway users must be familiar with and adhere to the slipway rules and regulations.
13.1 No trading or manufacturing (business or commercial) within the resort either on residential land or private open space is allowed.
13.2 No public auction or similar sales or public exhibition shall be held in any dwelling or on any part of the common property. Only the Board of Directors can authorize exceptions.
13.3 The homeowner/tenant shall not use his residential dwelling or permit his property to be used for any other purpose, which is injurious to the reputation of the development/building/dwelling or cause, create, permit or allow any noxious odour or industrial type of noise to emanate from his dwelling or any portion of the common property. This also in accordance with the Kouga Municipality bylaws.
14 OVERCROWDING OF ACCOMMODATION.
14.1 Overcrowding is not allowed.
14.2 The Directors will use the Municipal Regulations with regard to overcrowding as a guideline, but they are not restricted by these Regulations.
15.1 Homeowners are requested to please erect their own post boxes.
15.2 This is essential for internal communication and delivery purposes.
16.1 No building whatsoever is to take place within the Resort, unless plans have been stamped and signed and approved by the Architectural Committee and the Kouga Municipality.
16.2 A copy of the Building Site Instructions is available from the website www.gamtooshomeowners.co.za. Also, a copy of the Building Site Instructions is always attached to the plans that have been passed, stamped and signed by the Architectural Committee.
16.3 All homeowners are instructed to read and abide by the Site Instructions.

17.1 When wishing to purchase electricity, please contact the GAMHOA offices for the relevant information.
17.2 When your electrician requires your EDU for installation, please contact the GAMHOA offices for the relevant information.
18.1 Homeowners who want to install a burglar alarm system are requested to have a silent alarm system installed. This in order not to disturb the peaceful and quiet nature of the neighbourhood, should the alarm be activated. Alarm systems can be linked to the GAMHOA preferred service provider and/or to other cellular telephone network providers.
18.2 Should a homeowner want an internal audible alarm fitted, then they must provide a local resident with access to the property to allow them to deactivate the alarm when necessary. This will then be allowed.
Any transgressing of the above rules will lead to corrective action being taken by GAMHOA. Fines could be imposed as directed by the Board of Directors. This after allowing the alleged offender an opportunity to object and to be heard.
Open fires in suburban areas are prohibited unless authorised by the local authority.
